Under the Code on Wages, 2019 [s.2(y)] — adopted by the Code on Social Security, 2020 — “wages” means all remuneration (Basic, DA, Retaining Allowance and any other allowance) except the specified exclusions: HRA, conveyance/travel concession, employer PF & pension contribution, statutory bonus, overtime, commission, value of amenities, gratuity and retrenchment compensation. If the excluded items (other than gratuity & retrenchment compensation) exceed 50% of total remuneration, the excess is added back to wages. Contributions above the ₹15,000 ceiling are voluntary.
Bonus is computed on the higher of ₹7,000 or this figure.
- Old laws: PF on Basic + DA + Retaining Allowance; ESI on gross salary; bonus and gratuity on Basic + DA.
- New Codes: PF, ESI, bonus and gratuity on “wages” as defined in s.2(y), after the 50% add-back.
- Total remuneration for the 50% test includes employer PF/pension contribution and statutory bonus; gratuity and ESI are not included (MoLE Additional FAQs, 16 Mar 2026).
- Gratuity is payable on last-drawn wages under the revised definition for separations on or after 21 Nov 2025, for the full period of service; ceiling ₹20 lakh.
- ESI coverage: wages up to ₹21,000/month (employer 3.25%, employee 0.75%). Statutory bonus: eligibility ₹21,000/month, minimum 8.33%.
- Not included: EDLI & EPF admin charges, Professional Tax, LWF, TDS. Gross salary is held constant — if CTC is fixed instead, the extra cost comes out of take-home.
